Terms and Condition

 

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE APPLICATION OR OUR PODS. BY YOUR USE OF THE APPLICATION OR OUR PODS YOU AGREE TO THESE TERMS AND CONDITIONS.

 

 The following terms & conditions and any other rules posted on our Application (collectively the "T&C") constitute an agreement between TAG POD ("TAG POD", "we", "our", "us") and you, the Client (“he or She “), governing your access and use of all content and functionalities available on the TAG POD mobile application.

TAG POD Application is owned and operated by Personal Units Sport company. under the laws of the Kingdom of Saudi Arabia, with commercial license number 1010737046, registered office at TAKHASOSSI SR, Building No. 3809, 13322, Riyadh Kingdom of Saudi Arabia.

By registering on our application, you are accepting and consenting to the practices described in the T&C. We may modify the T&C from time to time and your continued use of this Application (or any of our other Platforms coming in the future) following such change shall signify your agreement to be bound by the modified T&C.

In particular, we draw your attention to our policies relating to the terms of subscriptions and our Privacy Policy. If you are under 15, you must let your parent or guardian know about TAG POD’S TERMS and CONDITIONS before you register to use this Application.

Please read the T&C and check back often. If you do not agree to any change to the T&C, then you must immediately stop using the Application.

 

 

• Registration & Account:

 

1. We at TAG POD allows both genders above 15 years old to register on our Application in order to use our PODs.
2. Registration is limited to your personal use and you can’t transfer your account to another user on anytime.
3. Your registration on our Application is completely free and we at TAG POD allows you to delete your Account at any time (please see Cancellations & Refunds Section for more details).
4. We have 2 different types of users:

 

1. Individual User: Personal Account which allow you access to all our public PODs on home screen, book them directly on our standard rates or subscribe to hours subscription plans.
2. Corporate User: Corporate Account which allow you access to corporate POD / PODs on your home screen only, however you can switch back to Personal Account in order to have access to our public PODs and subscriptions, Corporate PODs rates depends on the contract terms and conditions with your corporate.

 

• Subscriptions & Payments:

 

Simply no commitment! Currently the Application is following the concept of Prepaid or Pay-As-You-Go; you can book any of our PODs for 50 mins as the below booking or subscription plans:

 

1. Single Booking: At any of our PODs, just select your preferable POD, check date and time that suits you as per the available free sluts.
2. Hours Plans: We offer vary of Subscription plans that have different validity period clarified in each Plan so please ensure selecting the Plan that suits you best.
3. Corporate Subscription: Corporate subscriptions can vary depend on the corporate contract so please refer to your company in order to get the latest subscription deal.

Payments Methods: Currently the Application support the below payment methods

 

1. Apple Pay.
2. Mada Cards.
3. Credit Cards (VISA & Master).
4. Subscribed Hours (your subscribed hours can be used to book PODs or adding extra Person).

 

Personal Trainer: We provide you with Personal Trainer based on the Personal Trainer availability and schedule; while booking the POD if a Personal Trainer is available within the session date and time, a pop-up will appear giving you the choice to book the POD with a Personal Trainer (he or she depending on your gender), with extra fee which will be mentioned in the pop-up.

 

Adding Persons: We allow you to add more Persons at the time of booking or even at the time of the session by paying extra fee or by using any of your non used subscribed hours. (Please refer to section Facility Terms).

 

Promotions: While processing your booking or subscription of any of our Plans we allow you to insert a Coupon code which we may issue from time to time through our Marketing channels, SMS, social media or any of our partners.

 

 

We reserve the right to change Prices, subscription Plans and Coupon from time to time according to our policies.

 

 

 

• Cancellation & Refund:

We allow you to delete your account at any stage without any additional notice or costs required from your side however Any un-used hours (remaining from any subscribed Plan or single booking you made and not used yet won’t be refunded at any stage and by accepting this T&C You agree that fees are non-refundable and non-transferable to another account under any circumstances.

 

 

 

Facility Terms:

 

Access:

          To access our POD, you need to scan the QR code which is available on the Application through Track screen and shall not try to interfere more with the device equipment, if for any reason you faced any issues, please contact our Service Support Center through the Application (chat with us), our agents or employees will help you out fixing the problem through the Application itself or by the POD helper.

 

 

Extra Persons Terms:

          -Each POD will have a max capacity of Persons which is shown clearly on the Application under each POD, at any time before the session you can add more Persons to join you in the session for an extra fee or by using any of your hours available and always not to exceed the POD capacity.

 -Client takes full responsibility on the Persons behavior, health, complying with Tag Pod T&C and to join the session without any responsibility on us.

-Client has to follow the rules and regulations of the Kingdom of Saudi Arabia and not to allow any person from another gender to join him or her during the session and we shall eliminate your subscription and account without any further notice in case this or any other T&C or rules and regulations from the Kingdom has been violated or miss used against this T&C or the Kingdom of Saudi Arabia Laws.

 

 

Session Period:

All our sessions are limited to 50 mins only, and we keep remind you with the session ending time by sending notifications over your mobile Application or through the POD screen which has a timer on it, under any circumstances client must commit to the end of Session time to allow our POD Helper get the POD ready for the next session.

 

POD Equipment:

 You agree to use the POD through the instructions provided in the POD and in the proper use. You agree to use the equipment in accordance with the POD’s guidelines and to report any equipment malfunction or damage to us immediately.

 

Indemnity:

You agree to indemnify and hold harmless the POD and its employees, agents and contractors from any and all claims, damages, liabilities, costs and expenses arising out of or in connection with your use of the POD’s facilities, equipment and services.

 

 

Code of Conduct:

 You agree to comply with the POD’s code of conduct. Any behavior that is deemed inappropriate, disruptive or offensive may result in your immediate expulsion from the POD without refund. (Please refer to Termination section) .

 

Health and Safety:

You acknowledge and understand that the use of POD facilities and equipment carries certain risks. You agree to use the facilities and equipment at your own risk and to take all necessary precautions to ensure your safety and the safety of others who may join you in the session.

 

Liability:

Tag Pod and its employees, agents and contractors shall not be liable for any injury, loss or damage to personal property suffered by you while on the premises of the POD, except to the extent caused by the negligence of the POD or its employees, agents and contractors.

The POD Helper, directors, shareholders, members, clients, employees, agents, as well as each Personal Trainer that provides any fitness training services, and their respective successors, heirs and assigns do not accept any liability whatsoever for any injury or death of any person, loss, destruction of or damage to any personal property, causes of action, known or unknown, that may occur as a result of the use or misuse the facilities geared towards exercise, sports, and other physical activities (the “POD Facilities”).  

 

Termination: The gym reserves the right to terminate your usage without notice or refund if you breach any of the terms and conditions set out herein or if your behavior is deemed inappropriate, and not to follow the laws of the Kingdom of Saudi Arabia.

 

Privacy: The gym collects and processes personal information about you in accordance with its privacy policy, which can be accessed on The App (Please refer to our Privacy Policy Page).

 

 PERMITTED USE:

 

For the purposes of these T&C, use of the Application shall be restricted to the scope defined in the functions of the Application. The Client is prohibited from using the Application in any manner beyond the scope of these T&C. Except as expressly stated in these T&C, the Client has no right (and shall not permit any third party) to copy, adapt, reverse engineer, decompile, disassemble, modify or make error corrections to the Application in whole or in part except to the extent that such amendment is necessary for the purposes of use of the Application and integrating the operation of the Application with the operation of the device or software used by the Client.  

The Client has no right (and shall not permit any third party) to copy or use the Application or related documentation in any manner that is not expressly allowed by the T&C;

Decompile, reverse engineer, or otherwise attempt to derive the source code for the Application or any underlying algorithms, user interface techniques, or other ideas embodied in the Application; Distribute any copy of the Application or related documentation except as expressly allowed by the T&C, or allow anyone to have access to or use the Application;

Use the Application or its output to create, modify, or simulate designs for third parties;

Use the Application or its output to develop or enhance any product that competes with the Application.

 

 

 

 

DATA PROTECTION

 

We shall:

 

1. process or use data exclusively according to the instructions of the Client. If the Company considers an instruction given by the Client to be in breach of the Data Protection Laws, then the Company shall inform the Client of this breach without any unreasonable delay.

2.The Company confirms that it is familiar with the Data Protection Laws and shall instruct its employees and contractors accordingly. The Company shall take all the technical and organizational data protection measures necessary to ensure compliance with the Data Protection Laws.

 

3.The Company agrees to advise the Client immediately in the event of any significant interruption of business, suspected infringements of the Data Protection Laws or other irregularities encountered during the processing of the Client’s data. The Client shall advise the Company within a reasonable timeframe should it discover errors or irregularities when inspecting the work results.

 

4.Any content the Client uploads to the App will be considered non-confidential and non-proprietary. The Client retains all ownership rights in the Client’s content, but the Client is required to grant the Company and other users of the App a limited license to use, store and copy that content and to distribute and make it available to third parties.  

 

5.The Company will not be responsible, or liable to any third party, for the content or accuracy of any content posted by the Client or any other user of the App.

 

6.The Company have the right to remove any posting the Client made on the App if, in the Company’s opinion, post does not comply with the content standards set out by the Company.
